That depends, using ones color is of course, always allowed.
Though using ones images, but changing the color is copyright violation.
So it really depends on the things done by the ''violator'' and the ''creator''.

I understand what you mean, but i don't think your example is very good.

I personally think the ideas we have developed for this site are fine to re-use. Giving credit would be nice though, especially if the design is almost identical. Especially considering the ammount of work that was put into it.
