using smilies not made by myself allowed in mod?

Does anyone know whether I could use images like this

in a mod of mine or would that be against some kind of copyright?

i didnt create this one and i do not know who did either ...

Hi,

copyright works like this usually: Whenever somebody creates anything, it's automatically under his copyright. This means you are not allowed to use it yourself. Except he releases it under a free license (GPL for example), in which case you are allowed to under terms of that license.

So the answer is no, you're not allowed to use it without permission.

No problem, if you need custom images you can always ask in the image request forums, if you're lucky somebody will help you out.
